Terms of service
General Terms and Conditions (AGB)
1. Scope of Application
These General Terms and Conditions ("AGB") apply to the use of our online store by consumers and to all orders and purchase agreements concluded through the online store.
Our online store is intended primarily for consumers located in Germany and other countries within the European Union.
A consumer is any natural person who enters into a legal transaction primarily for purposes that are outside their commercial or independently professional activities.
An entrepreneur is a natural or legal person, or a legally capable partnership, acting in the course of its commercial or independent professional activities when entering into a legal transaction.
Customer terms that differ from these AGB will not become part of the contract unless we have expressly agreed to them in writing.
Nothing in these AGB is intended to restrict mandatory statutory rights available to consumers.
2. Seller and Contact Information
The online store is operated by:
DENCKER A/S
Færøvej 2
7900 Nykøbing M
Denmark
Email:
📧 do8446379@gmail.com
Where required by applicable law, additional company, registration, and legal information will be provided in the legal notice (Impressum) available on our website.
3. Services Provided by the Online Store
Our online store primarily provides the following services:
-
Presentation and sale of products;
-
Product information;
-
Order submission and processing;
-
Payment processing;
-
Order administration;
-
Dispatch and delivery of purchased products;
-
Customer support;
-
Return and refund processing;
-
Replacement services where applicable;
-
Handling of statutory conformity and product-defect claims in accordance with applicable law.
We reserve the right to temporarily modify, restrict, suspend, or discontinue certain functions of the online store where reasonably necessary for technical, security, operational, or legal reasons.
Any mandatory statutory rights of consumers remain unaffected.
4. Use of the Online Store and Customer Accounts
Certain features of the online store may require customers to create an account.
When registering an account or placing an order, customers must provide information that is accurate, complete, and up to date.
Customers are responsible for:
-
Keeping their login credentials confidential;
-
Preventing unauthorized access to their account;
-
Updating account information when necessary;
-
Informing us promptly if they suspect unauthorized access;
-
Not using a false identity or impersonating another person.
Customers may not sell, transfer, or permanently provide their account to another person without our prior consent.
Where we have reasonable grounds to suspect fraud, misuse, unlawful activity, unauthorized access, or a serious violation of these AGB, we may restrict or terminate account access to the extent permitted by applicable law.
5. Formation of the Contract
Product listings displayed in our online store generally constitute an invitation for customers to submit an order and do not themselves constitute a binding offer to conclude a purchase contract.
Customers may add products to their shopping cart. Adding a product to the cart does not constitute a binding purchase.
By submitting an order, the customer makes a binding offer to purchase the products listed in the order.
Before submitting the order, the customer can review the selected products and entered information and make corrections where necessary.
After an order has been submitted, the customer will normally receive an automated email confirming receipt of the order.
An automated order-receipt confirmation only confirms that the order has been received and does not, by itself, constitute acceptance of the customer's offer unless the confirmation expressly states that the order has been accepted.
A purchase contract is generally concluded when:
-
We expressly accept the order, for example through an order confirmation; or
-
We dispatch the ordered goods and the dispatch clearly indicates acceptance of the order.
If an ordered product is unavailable, payment cannot be completed, or the order cannot be fulfilled for another legally permissible reason, we will inform the customer.
Where payment has already been made and the order cannot be fulfilled, the relevant amount will be refunded in accordance with applicable law.
6. Products and Product Information
We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices, availability information, and other information displayed in the online store are accurate and current.
Because colors and visual details may appear differently depending on the customer's device, screen, browser, or display settings, the actual appearance of a product may differ slightly from its online representation.
Minor technical or visual differences that do not affect the agreed characteristics or contractual conformity of the product do not constitute a defect solely because of such differences.
If obvious errors occur in product descriptions, prices, stock information, or other website content, we reserve the right to correct such errors to the extent permitted by law.
The rights of customers under contracts that have already been validly concluded remain unaffected, except where applicable law provides otherwise.
7. Prices and Payment
The price displayed in the online store at the time the customer places an order applies to that purchase.
Any applicable delivery or shipping charges will be displayed during the ordering process before the customer completes the purchase.
Mandatory price information applicable to consumers, including applicable VAT information, will be provided in accordance with legal requirements.
The total amount payable, including applicable delivery charges, will be displayed before the order is submitted.
Depending on the destination, technical availability, and checkout configuration, available payment methods may include:
-
Visa;
-
Mastercard;
-
PayPal;
-
Cash on Delivery, where offered;
-
Other payment methods displayed during checkout.
Customers are not entitled to require us to provide a particular payment method.
Payments may be processed by third-party payment providers. Where applicable, those providers may have their own terms of service and privacy policies.
Unless otherwise required by law, we do not independently store complete payment card information.
8. Delivery and Shipping
Products will normally be delivered to the shipping address provided by the customer during checkout.
Estimated delivery information will be displayed on the website or during the ordering process where applicable.
Actual delivery times may be affected by factors including:
-
Order processing time;
-
Delivery destination;
-
Product availability;
-
Shipping providers;
-
Weekends and public holidays;
-
Weather or transportation conditions;
-
Customs or import procedures;
-
Events beyond our reasonable control.
Unless expressly stated otherwise, delivery dates or periods displayed on the website are estimates.
If a significant delivery delay occurs, we will provide appropriate information to the customer to the extent required by applicable law or the contract.
Mandatory consumer rights relating to delayed delivery remain unaffected.
For additional information, please refer to our Shipping and Delivery Policy.
9. Retention of Title
Where permitted by applicable law, ownership of delivered goods remains with us until the purchase price has been paid in full.
10. Statutory Right of Withdrawal
Consumers may have a statutory right of withdrawal when entering into distance contracts, subject to applicable legal requirements and statutory exceptions.
Detailed information concerning the withdrawal period, exercise of the right of withdrawal, return procedure, and legal consequences is provided in our separate:
Withdrawal Information / Returns and Refunds Policy
Nothing in these AGB is intended to restrict a consumer's statutory right of withdrawal.
11. Returns, Refunds, and Replacements
Returns, refunds, and replacements, where applicable, will be handled in accordance with our Returns and Refunds Policy and applicable law.
Mandatory consumer rights, including statutory withdrawal rights and statutory rights relating to defective or non-conforming goods, are not limited by our voluntary return or refund procedures.
Where a refund is due, it will generally be made using the original payment method unless another method has been lawfully agreed or applicable law requires otherwise.
12. Statutory Rights in the Event of Defective or Non-Conforming Goods
All products sold through our online store are subject to the mandatory statutory rights applicable to defective or non-conforming goods.
If a product does not comply with the contract or applicable statutory requirements, consumers may exercise the remedies available under applicable law.
Depending on the circumstances and legal requirements, available remedies may include:
-
Repair or other corrective action;
-
Replacement;
-
Price reduction;
-
Withdrawal from the contract where legally permitted;
-
Compensation or damages where legally applicable;
-
Other statutory remedies.
If a manufacturer provides an additional voluntary warranty or guarantee, that warranty is separate from the consumer's statutory rights.
Any voluntary warranty or guarantee does not remove or reduce mandatory statutory consumer rights.

This includes, among other things:
-

-
Written content;

Graphics;
-
Website design and layout;
-

Databases;
-
Other protected content made available through the online store.
Unless permitted by law or authorized by the relevant rights holder, protected content may not be copied, modified, distributed, publicly displayed, reproduced, or commercially exploited without prior authorization.
Legally permitted uses and mandatory consumer rights remain unaffected.
16. Third-Party Providers and External Services
We may use third-party providers to operate the online store and provide related services.

Where personal information is processed through these services, such processing will be handled in accordance with our Privacy Policy and applicable data protection laws.
Certain third-party services may also be subject to the provider's own terms and privacy policy.
17. Availability of the Online Store
We make reasonable efforts to keep the online store available and operational.
However, we cannot guarantee that the website will always be available without interruption or technical errors.
Temporary interruptions or restrictions may occur because of:
-
Scheduled maintenance;
-
Technical updates;
-
Server failures;
-
Network problems;
-
Security incidents;
-
Cyberattacks;
-
Failures involving third-party providers;
-
Technical errors;
-
Other unforeseen circumstances.
Where technically and commercially reasonable, we will make efforts to restore normal operation as soon as possible.
Mandatory consumer rights remain unaffected.
18. Liability
We are liable for damage caused by intentional conduct or gross negligence to the extent required by applicable law.
We remain liable for damage resulting from injury to life, body, or health in accordance with applicable legal requirements.
We also remain liable where mandatory statutory provisions impose liability, including applicable product liability legislation.
Beyond these circumstances, liability is determined by the applicable statutory provisions.
Nothing in these AGB excludes or limits liability that cannot legally be excluded or limited.
Mandatory consumer rights remain unaffected.
19. Force Majeure
If circumstances beyond our reasonable control prevent or materially interfere with the performance of contractual obligations, delivery or service may be delayed or temporarily restricted.
Such circumstances may include:
-
Natural disasters;
-
Extreme weather;
-
War or comparable conflicts;
-
Government or regulatory measures;
-
Major network or internet outages;
-
Significant transportation disruptions;
-
Serious failures affecting essential third-party providers;
-
Other unforeseeable events beyond our reasonable control.
We will make reasonable efforts to inform customers about significant delays and, where possible, take appropriate steps to resume performance.
Mandatory statutory consumer rights remain unaffected.
20. Data Protection
We process customer personal information in accordance with applicable data protection legislation.
Information about the categories of personal information we collect, the purposes for which it is processed, retention periods, data sharing, and the rights available to individuals can be found in our:
Privacy Policy
The Privacy Policy forms part of the information made available to customers in connection with their use of the online store.
21. Changes to These AGB
We may update these AGB where reasonably necessary due to changes in applicable law, technology, our services, our business model, or other legitimate operational reasons.
For contracts that have already been concluded, the version of the AGB applicable at the time the contract was concluded will generally apply unless applicable law provides otherwise.
Updated AGB will be published on our website.
Where required by law, we will provide customers with additional notice concerning material changes.
22. Governing Law
To the extent permitted by applicable law, these AGB and the contractual relationship between the customer and the seller are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Where a customer qualifies as a consumer and normally resides in another EU Member State, mandatory consumer protection provisions applicable in that country remain unaffected.
This choice-of-law provision does not deprive consumers of mandatory rights granted to them by the laws that apply to their situation.
23. Dispute Resolution
We aim to resolve customer complaints and disputes efficiently and amicably whenever possible.
If you have a complaint or concern, you are encouraged to contact our customer service team first:
Customer Support Email:
📧 do8446379@gmail.com
Nothing in these AGB affects a consumer's statutory right to contact a competent authority, court, or other legally recognized dispute-resolution body or to exercise any other legal remedy available under applicable law.
24. Severability
If any provision of these AGB is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions will not be affected.
The invalid or unenforceable provision will be replaced or interpreted in accordance with the applicable statutory provisions to the extent legally permitted.
